01. ticket sales
1 Object
1.1
Konzertfabrik Z7 operates a ticket sales organization. Ticket purchasers (hereinafter “Ticket Purchasers”) can purchase tickets for events via our sales channel. Konzertfabrik Z7 enables the direct conclusion of a contract between the event organizer and the Ticket Purchaser.
1.2
The subject of these GTC is the use of services that Konzertfabrik Z7 provides to Ticket Purchasers via its own sales channels: consent to these GTC is given by using the corresponding services. When using individual services, the Ticket Purchaser may be asked by Konzertfabrik Z7 to repeat his/her consent to the GTC by clicking on a corresponding confirmation field.
2 Services
The terms and conditions of Konzertfabrik Z7 accessible via sales channels apply to all services. Konzertfabrik Z7 may change the range of services or discontinue the provision of services at any time.
3 Conclusion of contract
3.1 Order of the ticket purchaser
The overview of available tickets provided by the sales channels is merely an invitation to the ticket purchaser to make an offer. The ticket purchaser makes his selection via the sales channel. The selection made is displayed in the shopping cart (web store) or communicated to the ticket purchaser (telephone order and advance booking office). By confirming the order, the ticket purchaser makes a binding offer to purchase the selected tickets. The ticket purchaser is obliged to provide all information required during the ordering process completely and correctly
3.2 Order confirmation
When ordering via the webshop or after completing the order process, the ticket purchaser receives an order confirmation by e-mail. This expressly does not constitute acceptance of the offer by Konzertfabrik Z7.
4 Delivery of the tickets
4.1
The ticket purchaser is obliged to check the tickets immediately upon receipt. The ticket purchaser must notify Konzertfabrik Z7 within 3 working days of any damage to the tickets or any discrepancies between the tickets delivered by post or electronically and the tickets ordered. If the ticket purchaser fails to do so, the tickets delivered shall be deemed to have been approved.
4.2
Benefit and risk are transferred to the ticket purchaser at the time of dispatch at the headquarters of Konzertfabrik Z7. The ticket purchaser is responsible for the safekeeping of the tickets until the event. The replacement of damaged or lost tickets is excluded.
5 No resale
Any trading with purchased tickets, in particular for commercial or business purposes, is prohibited. Violations may lead to the loss of the service associated with the purchased tickets and to claims for damages and prize money against the original ticket purchaser and the ticket purchasers. Persons who violate these provisions may be excluded from purchasing tickets.
6 Prices
The prices for tickets accessible via the sales channels or shown or communicated there are inclusive of VAT.
7 Returns, refunds and exchanges
Special features in the event of postponement of an event or venue:
If an organizer decides to postpone an event or change a venue, the ticket is valid for the postponed date or the new venue, regardless of the reasons for the postponement. It is at the discretion of the organizer to decide whether tickets can be returned, refunded or exchanged.
8 Obligations of the ticket purchaser when attending an event
By purchasing the ticket, the ticket purchaser acknowledges the safety, access, age and other implementation regulations of Konzertfabrik Z7 and acknowledges that he/she may be excluded from the event without compensation if these regulations are not complied with. The applicable regulations can be viewed at www.z-7.ch.
9 Newsletter / Communication
By purchasing a ticket, the ticket purchaser agrees that the contact details provided (in particular e-mail address) may be used by Konzertfabrik Z7 to inform him/her about relevant information regarding the booked event (e.g. postponements, security information) as well as about future events and offers of Konzertfabrik Z7. This also includes the receipt of our newsletter.
The ticket purchaser can unsubscribe from the newsletter at any time free of charge, e.g. via the unsubscribe link in every e-mail or by sending a message to info@z-7.ch.
10 Final provisions
10.1
The place of performance for the services of Konzertfabrik Z7, including the delivery of tickets, is the registered office of Konzertfabrik Z7.
10.2
The ticket purchaser waives the right to offset claims against Konzertfabrik Z7.
10.3
Konzertfabrik Z7 reserves the right to amend these GTC at any time. Changes come into force when they are published.
10.4
Should one or more provisions of these GTC be or become invalid or unenforceable in whole or in part, this shall not affect the validity or enforceability of the remaining provisions of these GTC or the purchase of the ticket. In this case, the parties shall replace the invalid or unenforceable provision with a valid and enforceable provision that comes closest to the economic purpose of the provision to be replaced. The same applies mutatis mutandis in the event that these GTC contain a loophole.
10.5
These GTC and any disputes arising from or in connection with the relationship between Konzertfabrik Z7 and the ticket purchaser shall be governed exclusively by Swiss law.
10.6
The exclusive place of jurisdiction for all disputes between Konzertfabrik Z7 and the Ticket Purchaser is the registered office of Konzertfabrik Z7. However, Konzertfabrik Z7 is entitled to sue the Ticket Purchaser at his domicile.
02. webshop
1 General information
The following General Terms and Conditions apply to all contracts, deliveries and other services. We hereby expressly object to any deviating provisions of the contractual partner. All subsidiary agreements require our written confirmation. Konzertfabrik Z7 is entitled to amend or supplement these General Terms and Conditions, including any annexes, at any time. Orders received prior to an amendment shall still be processed in accordance with the old General Terms and Conditions.
2 Terms of purchase and delivery
2.1
Our General Terms and Conditions apply to all written, telephone and online orders and are accepted with every order. Orders and deliveries are subject to the stated conditions.
2.2
We reserve the right to make partial deliveries if this appears to be advantageous for speedy processing. This will not result in any additional costs or additional shipping costs for you. Special shipping methods requested by our customers are not possible.
3 Prices and payment
All prices are quoted in CHF including the respective statutory VAT, excluding shipping costs. The prices are valid at the time of ordering. Our prices in the online store are updated daily. The sales prices valid at the time of ordering are those shown in the online store. We accept no liability for inadvertently incorrect price or product details, errors or misprints. The total of the invoice and settlement amounts can be assigned by us to third parties.
4 Delivery
Goods in stock (we are not liable for transportation problems) are normally dispatched within 3 working days. We reserve the right to make a partial delivery if this is advantageous for speedy processing. This will not result in any additional costs or additional shipping costs for you. If the goods are not in stock when the order is placed, we will take care of delivery as quickly as possible. If non-compliance with a delivery or performance deadline is due to force majeure, labor disputes, unforeseeable obstacles or other circumstances for which we are not responsible, the deadline will be extended accordingly. In the event of non-compliance with the delivery deadline for reasons other than those mentioned above, the purchaser shall be entitled to set a reasonable grace period in writing with the threat of refusal and, after its unsuccessful expiry, to withdraw from the contract with regard to the delivery or service included in the contract. If the impossibility of delivery is due to the inability of the manufacturer or our supplier, both we and the buyer may withdraw from the contract if the agreed delivery date has been exceeded by more than 2 months. Claims for damages due to delay or impossibility or non-fulfillment, including those that have arisen up to withdrawal from the contract, are excluded.
5 Right of return
You have a 10-day right of return or exchange. Send us the original invoice with the goods. As soon as your return has been processed, we will send you a new, corrected invoice with a payment slip.
6 Transfer of risk
The risk is transferred to the buyer when the goods are posted by Verein Konzertfabrik Z7.
7 Warranty
Konzertfabrik Z7 warrants that the goods sold are free from material and manufacturing defects at the time of the transfer of risk and that they have the contractually warranted characteristics. Upon arrival, the customer must inspect the goods immediately for defects and quality. In the case of obvious defects, these must be reported to us in writing or by telephone within 7 days of discovery, as must hidden defects. Otherwise, the warranty for these defects shall lapse. In the case of complaints, the date of purchase must be proven with an invoice. The item complained about must be sent in together with a copy of the invoice. The warranty does not cover normal wear and tear. The warranty expires if the customer modifies the delivered goods.
8 Retention of title
The risk is transferred to the buyer when the goods are posted by Verein Konzertfabrik Z7.
9 Data storage
Personal data will of course be treated confidentially. We process your data for order processing and to maintain the ongoing customer relationship.
10 Place of jurisdiction
The contracting parties agree that Swiss law shall apply. The contractual language is German. The place of jurisdiction is Liestal, BL.
